1. Order processing
Your order will be processed immediately upon receipt;
1.1 Please note that, in the case of items that are not immediately available in stock ("to order"), the customer must make payment in full, and the estimated/predicted delivery date will be indicated.
1.2. In the event of a stock out, the customer will receive contact from us via email, with a replacement suggestion or information about its availability and estimated delivery time. After confirmation by the customer, the order will be sent subject to item availability.
1.3. If, in this last case of stock outage, you do not wish to wait for the ordered item to arrive or its replacement, BabyCool will reimburse you for the amounts paid within a maximum period of 30 days from the date of becoming aware of this unavailability;
1.4.. Orders are sent to the address indicated by the customer only after payment confirmation;

3. Cancellations
3.1. In case of order errors attributable to BabyCool, the customer will receive the correct item at no additional cost;
3.2. It is not possible to refund shipping costs in the event of order errors attributable to the customer.
4. Returns and Exchanges
4.1 The customer may return the product within 14 days of delivery or exchange it within 30 days, but must have proof of purchase. The shipping costs for returning, replacing or exchanging items are the sole responsibility of the customer.

5. Pricing Policy
5.1. Despite its efforts, some products may be incorrectly priced, which is why BabyCool checks prices every time it processes orders. If the actual price of the product is lower than the advertised price, BabyCool will refund the difference. If the effective price is higher, BabyCool will inform the Customer of this situation by email and will await their decision to accept the new proposal or cancel the order within 15 days from the date on which this was communicated to them.
5.2. In the event of a computer, technical, human error or error of any other nature, which causes a substantial change, not foreseen by BabyCool, in the selling price to the public, in such a way that it becomes exorbitant or manifestly derisory, the request purchase order will be considered invalid and void;
5.3. All prices indicated on the website include VAT at the legal rate in force;
5.4. Prices and specifications are subject to change without notice;
5.5. BabyCool reserves the right to modify at any time the information and commercial offer presented regarding products, prices, promotions and commercial conditions and services;
5.6. Promotions advertised on the website are limited to existing stock.
5.7. The prices charged at www.babycool.com are exclusive to the BabyCool online store and may be different from the prices in the physical store.
6. Contents
6.1. The User undertakes to use the information they have access to for exclusively private purposes;
6.2. The user agrees that use of the website must be at their own risk. To the fullest extent permitted by law, BabyCool disclaims any warranties, express or implied, in relation to the use of the website;
6.3. BabyCool reserves the right to interrupt or suspend access to the babycool.com website for the period strictly necessary and for any technical, administrative, force majeure or other reasons.
6.4. All information and, in general, the content of the website may be changed without prior notice;
6.5. BabyCool is not responsible, nor assumes any responsibility or obligation, towards the User or third parties, for any cost, expense, harm or loss, regardless of their nature, resulting from (i) any inaccuracy, inaccuracy, error, omission, deficiency of data or any information provided through this website and in communications sent by this website, (ii) delays or interruptions in the provision of data or any information provided through this website, (iii) errors, viruses, “trojans” or similar that may be transmitted to or through the website, (iv) any decision taken or action taken by the User or by third parties based on the information provided through this website, even if it is inaccurate or incorrect;
6.6. When accessing Websites through links provided by BabyCool, the User agrees that the information obtained through these links was created by third parties, and Babycool does not have any editorial responsibility for it. The links are presented for indicative purposes only, meaning that BabyCool is not aware of any consequences of accessing them.
7. Intellectual Property Rights
7.1. The User acknowledges that the information, as well as the databases to which they have access, constitute the intellectual property of BabyCool or third parties, such as suppliers, brands or entities that contribute to the creation or maintenance of the website, and undertake to refrain from if the practice of any act that, under applicable legislation, may constitute a violation of the rights that BabyCool or such entities, as the case may be, hold;
7.2. The content of the website is provided for information and personal use only and may not be used, copied, reproduced, distributed, transmitted, disseminated, sold or in any way made accessible to third parties, except for exclusively private purposes and free of charge. The User is solely and exclusively responsible for the misuse of the information to which they have access within the scope of this website.
8. Dispute Management
Babycool joined the Consumer Conflict Arbitration Center of the District of Coimbra to regulate, through Voluntary Arbitration (Law No. 63/2011, of 14 December), eventual and future consumer conflicts arising from the supply of goods or provision of services to a consumer, carried out in its establishments, agencies or branches and whose value does not exceed 5,000.00 euros.
